Help on getting my children returned to me… first time user so please bear with me?
My ex partner has a court order to have the boys over night at a weekend, he didn’t return then last Saturday and took them to the police station to say he was breaking order, the police could only check boys were safe and happy to be with there dad and they said yes.
Since then he won’t let me see then or speak to them, it was in court today and he applied for sole residency which he didn’t get and has told people that boys want to live with him, they are 12 and 10, yet no one has spoken to the boys without there dad being there to give true answer.
I am desperate to see then and hug them, I am 5 months pregnant and have tried every avenue I can to sort it, I am being treated like a criminal when all I have ever done is love them, I am biased but they are two great boys who are well mannered and polite… all I can hope is the truth of what a control freak their dad is will out soon. Anyone got any advice, I am desperate,, thanks

Well, i understand your situation. What you can do now is fight. Fight for your children, and for your right as their mother. Who is he to take your children whom you held for 9 months in in womb each and gave them life, who is he to take them away from you? If you know you’ve been a good mother you have nothing to worry about. However if you did something and your children have told him, you are screwed. He will use anything against you. Trust me I know this. As for your pregnancy situation, don’t stress so much because anything that happens might alter your blood pressure or anything else and you don’t want that. Get yourself a damn good lawyer. You’re gonna need one. This is gonna be a long journey.

So when you were in Court, today, didn’t you think to mention to the judge that the children had been removed? If the father’s application for Sole Residency failed, then it is implied that the children have to be returned to you at some time!

In a Court of the Family Division, the judges are meant to be a bit smarter than the ones in Adult Courts, and actually ask the Children (in private) what they want, discuss their concerns with them and usually appoint a Welfare Officer to keep an eye on them. They do not need to be told by lawyers what to do, as they are meant to look after the best interests of the child, whilst lawyers play an adversarial game and try to pour abuse on one or the other of the parents to show just how bad they are: precisely what you do NOT need in matters concerning children. And, not least, beause the two feuding parents have to try to continue a relationship, as they share the children, and lawyers really mess that up!

HOWEVER, do note that this is NOT a battle to decide whose children they are (the traditional father/mother ownership argument) but one to decide their welfare on the basis that BOTH parents have a place in their lives!

Talk to a Lawyer if you feel that you need representation, but I do wonder why that should really be necessary.
